How to Handle Business Disputes
Suggestions for Handling Disputes
Any conflicts involving customers, employees or suppliers, or a partner, is very disruptive. Disputes and conflicts cannot be allowed to escalate because of the damage they can cause. There are ways of dealing with disputes, to arrive at an agreement or resolution where all parties concerned are satisfied.
Here are a few suggestions for handling a dispute:
- Focus on your long-term interest.
Try to find an outcome where your business retains its best interests as its main objective. Don’t get obsessed with winning a particular dispute or conflict if that is not necessarily the best position for the business in the long run.
- Find something simple and quick, and resolve that first.
The best resolution is usually that which can be quickly agreed to. The longer a dispute drags out, the more costly it will become and the heavier the disruption to your business, as well as your own personal life. Even if there is some cost involved, it is far better to settle the matter fast.
- It’s not personal – it’s business.
If you are in business, you will have to get used to the fact that you will be a target of complaints from someone, whether it be a customer or supplier. No one is perfect and no business is perfect, so expect that things may not always work out as planned.
However, you have to ensure that you don’t take these attacks personally, but try to focus on the issues involved, rather than the personalities involved. Remember it’s not personal – it’s business.
- Avoid court.
If you can avoid it, do not go to the courts with your quarrel. Using lawyers and the court’s time is an expensive exercise and can tie up the business and yourself for some period of time. It also creates a lot of stress, which could be avoided by settling for something a little easier or acceptable to both parties.
The trick is to avoid going to the law unless there is no other solution. If at all possible, have open discussions with the other party, as they will also understand the time and cost wasted by going to the court. It is far better for both parties to work out a solution outside of legal action. This should be the priority or aim of a meeting set to resolve a conflict.
- Find if there is an alternative to resolve the dispute.
You may like to investigate whether mediation or arbitration is a fair alternative of finding a resolution. Mediation simply provides for a neutral third party to sit in on discussions while the two parties try to come to a resolution.
Mediation is not binding on any party; it is a means of opening up communication to find a resolution. Arbitration however is where two parties sit before a person, known as the arbitrator, who will make an award or decision after hearing both sides of the story. The decision of the arbitration is binding.
- Conflicts need to be Resolved Delicately.
Conflicts are inevitable. The sooner you as a business owner realise this, the better. The trick is to try and arrive at a positive outcome, so both parties are happy. You need to remember that each party has different priorities and agendas and they are looking at the conflict from two different perspectives.
There are certain characteristics, however, that come across and these include:
- People hate to have others disagree with them.
- People definitely like others to agree with their views.
- People love to be agreed with.
- People don’t like others who disagree with them.
- People who are good at resolving conflicts look for a point of agreement and use their skills to get the other party to see their point of view.
Resolving the conflicts can be a delicate exercise. The only way to win in a conflict is to arrive at the position where both parties leave the meeting feeling that at least they have won something. That is, try to find a win/win solution. If you don’t, and you win your argument, you may take home more cash or win on the issue, but you will lose a customer, client or friend forever.
Try and see if it is possible to go down the middle, where each party leaves with a 50/50 win and there is satisfaction, because 50% is better than nothing. There is also the realisation that the other party got away with only 50% (rather than 100%) of what they wanted as well.
Always try for win/win and try never to allow the conflict to escalate too quickly or too far, certainly not to the point where it is difficult to recover the position.

The portable computer industry has gone from strength to strength recently. It seems the poor manufacturers are also facing issues that could keep us all waiting. This is one trade which I don’t think will be affected with all the financial peril that seems to be going on. The technology is developing in all directions at once too.
A lot of manufacturers have been coming out with gaming laptops recently. These notebooks are also growing in value because of the stern competition faced from cheap laptops. In my opinion laptops are pretty good for gaming. Processing power is much advanced than before. I think what’s vastly impressive is how slim the designs are and how cool the units run. Regardless off all the good things of laptops, desktops should always perform faster than them. It’s a niche to keep tabs on as purchasers are searching for portable, more powerful systems as we speak.
Speaking of gaming laptops, the most choice are available when they are custom built. With custom built laptops you commonly get to know what brand of components is going into the notebook. You can normally save money on specs you don’t need by specing the notebook to your needs. Regardless of the fact of there being tons of laptop computers in the stores its slim you will discover a lot of choice of powerful portables. You can get a more suitable laptop by buying one built to spec. I think you also get superior service when buying a custom notebooks. The fact that there are alternatives and rivals makes its very viable.
The outlook of upcoming notebooks seems exciting. The popular trend along with those discussed seems to be low cost ultra portables. I didn’t think anyone thought they would be so popular. These days customers want slim laptop computers but they also need massive lcd’s. If you employ slightly less slower components then I reckon this is really possible already. Consumer trends indicate that gaming laptops will get increasingly lighter in the next couple of years. New laptops are commonly not mentioned of before their introduction so theres no knowing what new innovations we will encounter.

Small Business Marketing
The term market refers to the aggregate of all demand for a particular product or service arising from the aggregate of all consumers – both existing and potential for the product. Markets vary widely from one another since the consumers who constitute the markets vary widely in their characteristics. Even a specific market for a given product is not totally homogeneous.
In small business marketing, a market is split up into several smaller units, each with homogeneous characteristics; it facilitates the effective tapping of the market. Market segmentation is the process of disaggregating the total market for a given product into a number of sub-markets. The heterogeneous market is broken up in the process into a number of relatively homogeneous units.
The process is based on the recognition that any given market or consumer group is made up of a number of subgroups distinguished by varying needs and buying behavior. Also, it is feasible to disaggregate the consumers into suitable segments in such a manner that the characteristics of the segmented groups would vary significantly among segments but would also be identical within segments.
Market segmentation confers several benefits on the marketing man. In the first place, it helps him distinguish one customer group from another within a given market and thereby enables him to decide which segment of the market should form his target market. It also enables the effective crystallization of the specific needs of the buyers in the target market and facilitates an in-depth study of the characteristics of the buyers.
When the buyers are approached after careful segmentation, responses that are predictable would be forthcoming from them. This would help the marketing person develop his marketing program on a predictable and reliable basis. When the needs and characteristics of the customer group have been brought into a clearer focus, marketing offers that are most suited to the particular customer group can be easily developed.

2005 Super Bowl Ads… Winners and Losers
Well, Super Bowl XXXIX is history. Too bad for the folks who
consider themselves the always-pullin’-for-the-underdog
type. The Bandwagon team won.
But, as far as Super Bowls go, the losers played well. For
those who care, the Eagles actually covered the 7-point
spread. T.O. is the deal, too. At least on the field, anyway.
They had a chance late in the game, but poor field position
and bad clock management did them in. Scoring from 95
yards out with 48 seconds left? That’s a tall order.
So is getting/maintaining ad recall 48 hours after the final
gun. Whose $80,000 per second ad was worth it? Who
would’ve done better by writing me a fat check for $2.4
million?
Read on, and find out. True to school yard rules: Suckers
Walk. Losers are up first.
Losers:
Sorry, Donovan, but your three picks lands you in with
GoDaddy.com, Quizno’s, and Silestone. I don’t care if you
were ill.
GoDaddy.com had a decent concept that quickly went bad.
OK. Boopsie talking to a Senate subcommittee on C-SPAN
about indecency. Good start- if they cut out any hint to last
year’s halftime debacle. But… they couldn’t resist. So the
buxom wench wearing a GoDaddy.com t-shirt has a near
wardrobe malfunction. One of the craggy senators has to hit
the oxygen mask.
This ad was supposed to run again, but Fox pulled it mid-
game. Good idea. I bet their stomachs were in as many
knots as Donovan McNabb’s.
The Quizno’s ad was mediocre at best. This talking baby
concept is tiresome. As cliché as it may be, it’s still 80%
less annoying than those whack rodents in pirate hats from
a couple of years ago.
The one stinky Bud Light ad was one that the ESPN crowd
really dug – the parachute-less pilot heading out the door for
the six of Diet Bud. Dumb. The desert island one with
Cedric the Entertainer was iffy, too.
Speaking of stinky… what was up with Napster’s ad? Ugh! It
could wind up doing more to shut them down than the
Supreme Court.
This bad concept was in stark difference to their introductory
spots featuring Flash animation based around their logo.
Those were well-designed and entertaining. This one was
as fat and ugly as the seven shirtless blops they decided to
show with a letter on each of their overdeveloped beer guts
to spell N-A-P-S-T-E-R. It was done in house and, boy, did it
show.
The manufactured “reality” of the game and its atmosphere
was lame and no one bought it. An ad taking place at the
Super Bowl should be IN the Super Bowl- done real time.
And… trying to take on Apple’s iTunes on price? That was
the second dumbest decision of this ad. No wonder it
finished dead last in likability and recognition.
Now… Silestone. Valiant effort of an ad featuring Chicago
sports legends. Voice over was good. It was shot nicely.
But, it was a little too jumpy in the cuts to get the whole
picture the first time through. The quick cut style hurt the
name recognition of the line of counter tops.
Silestone and Diana Pearl are not exactly household
names. And Dennis Rodman slurred his line. It sounded
like “Dinah Pearl, rather than, “Diana Pearl.” I’m sure the
director or writer got dissed when they said, “Uh, Worm… it’s
‘Di-A- na’.”
“Sure. Dinah.”
As a side note, why were only Chicago Bears in it until
Dennis Rodman at the end? No Scottie Pippen or Slammin’
Sammy?
On to the good ‘uns…
Winners:
This year, the game was nearly as good as the ads, as
there were a surprisingly good number of breaking spots.
Leading the pack was Career Builder, FedEx, Mastercard,
and Anheuser-Busch.
FedEx likes to make ads relating to advertising on
advertising’s biggest stage. They did it again – patching
together 10 “tried and true” Super bowl ad conventions to
great results.
Career Builder put a great spin on a stale category with the
best work since Monster’s “I Wanna Be…” [a brown noser,
forced into retirement, etc.] from ‘98. Three ads featuring a
hapless chump working for chimps managed to put their
name into mind share largely dominated by two others.
MasterCard got a bunch of animated branded food icons
together for a meal and a nice touch of nostalgia. Ad fans
and agency folks dug this one.
A-B hit emotional hot buttons with a near-public service ad
saluting troops retuning home. Yes, they were real military –
not actors. Their uniforms just did not have any insignias,
so the common soldier would be represented. For their light
beer category, the ad with the head on the wall and the
designated driver spot were the best for Bud Light.
Pepsi’s second year of an iTunes promotion kicked off well.
They ran a humorous spot featuring people opening
winning bottles for a free song. When the bottles were
opened, a song reflecting the drinker’s taste in music would
play. Although the spot was humorous and worked, Pepsi
could’ve really hit a home run by involving the older
“authority figure” more into the ad. But, keeping with brand
tradition, they kept the focus young.
AmeriQuest had two entertaining spots revolving around the
themes of misunderstanding and jumping to conclusions.
Their message was, “We don’t prejudge.” The ad featuring
spaghetti sauce, a cat, and knife will certainly make some
‘Best Of” reels this year.
Decent work also included Honda’s new pickup/SUV
product introduction. Good detail with benefit highlights. Left
the “Honda” out until the end. Cadillac and Volvo had solid
ads. Volvo should have bought another ad, if not two, as
many people missed the early run. The audience also may
have missed the details on their unique contest. But they
did follow up with some net portal ads the day after. Ford’s
F-150 Biker spot was OK. Their line that “it makes YOU
tough,” really undercut the effectiveness.~

Birdwatching – Connecting Kids to Nature!
What child hasn’t been delighted to see his first bird up close?
Maybe it was a humble sparrow or a squawking seagull — whatever they are, birds are a natural delight to watch and can be seen anywhere in the world.
If you are looking for an activity that you can enjoy with your children, whether they’re five or 15, you might want to consider the popular hobby of bird watching. It is one of the fastest growing outdoor activities in America — and a great way for families to enjoy time together.
What IS Bird Watching?
Bird watching is more than just observing birds. It is an interest in the actual birds — their names, markings, activities, songs and habitats. Not only does it encourage a child (or an adult) to learn about birds, but gets them outside and builds an appreciation of local wildlife and nature.
Bird watching doesn’t require a strong knowledge of birds; you can learn with your children as you begin to locate and identify local wild birds. Keep a list of the birds you’ve spotted and help one another identify what you’ve seen by making notes of the color, size and markings on the bird. You may even start to learn their calls and challenge yourself to identify the birds by their songs.
Where Can You Go to Bird Watch?
Bird watching can be as simple an activity as setting up a bird feeder in your backyard and watching the local wild birds that come to you. However, your children will no doubt appreciate time spent outdoors, properly geared up for an outing of bird watching with you.
You will soon learn about the specific habitats that birds live in around your home. As you become familiar with local birds you may even want to take trips to areas that will feature different species than you have locally. Watch as your children eagerly try to identify these new birds before you do!
What Do You Need?
Bird watching is a very inexpensive hobby. If you are going to be outside you will want everyone to have proper attire — including an extra pair of socks and a hat.
Other than that you will need at least one pair of binoculars, although it is more fun if everyone has their own pair so nobody misses out on a sighting. There are special binoculars for kids. You’ll also want a bird book (called a field guide) to help you identify the birds you see. If you take along one that features birds in your area it will also give you suggestions about where you can find them.
If your children are older, or you catch the bird watching bug, be sure to take along a notepad and camera. Make notes on birds you can’t identify and look them up at home with your children to determine what you saw. You might also develop a list of local birds and check them off as you see them. This is great for kids who thrive on challenge!
Don’t miss out — watch birds in your backyard daily. Just put up a feeder to get started. But if you really want to attract birds add a bird bath. You and your kids will have even more fun if you put up a birdhouse (nestbox) to watch a new family of baby birds being raised.
Bird watching is a fantastic hobby that the whole family can enjoy. Try it one afternoon and see for yourself how your family bonds while enjoying the fresh air, local scenery and most of all … the natural world!

The 5 Be’s of Motivation
It’s not true in every organization, but it is true in many. Managers often don’t understand their employees. They don’t know how to motivate, inspire, and correct people effectively. As I work with my clients, I hear the same questions repeatedly: “How do I get my employees to …
…quit complaining?”
…do more than the bare minimum?”
…contribute in meetings?”
…show up on time?” etc.
I also hear all kinds of answers for each situation. Some proposals are good, and some are not. The good suggestions show an understanding of human nature and an effort to apply behavioral principles. The bad ones usually feel good to the manager, but they violate some basic principle of human relations.
Human behavior is a complex subject. However, events that appear to be random, isolated behaviors actually fit into predictable patterns for most people. If you understand the patterns, you will know what to do in most situations. I’ve developed the Five Be’s of Motivation to reduce these patterns to five easy to remember and apply principles.
So, let’s get started…
1. Be Positive
People do things for one of two reasons: to avoid pain or to pursue pleasure. As a manager, you constantly work between these two options. If you use negatives – like verbal reprimands, threats, or other punishments – to drive behavior, people will do just enough to avoid the pain. You will condemn yourself to bare minimum effort from your employees. If you focus on rewarding good behaviors, you improve the odds that you will get cooperation and extra, discretionary effort rather than conflict, complaints and bare minimum performance.
Noticing unacceptable behaviors and stopping them with punishment is easy. It takes effort to recognize good behaviors and praise them. You need to do both; but the more you recognize the good, the less likely you are to see the bad.
2. Be Specific
Make sure you speak only about specific behaviors. Whether you administer discipline or offer praise, the more specific you make your words the better.
Emotional involvement (anger) from a negative situation often makes specificity a bigger challenge during discipline. For example, one of your employees consistently challenges you in meetings. Many people get angry at the situation and tell the employee to “stop being rude and inconsiderate.” Well, “rude” and “inconsiderate” are interpretations of behavior, not behaviors. A better statement would be, “I don’t appreciate it when you interrupt and challenge me. I see those behaviors as rude and inconsiderate. I won’t do it to you, and I don’t expect you to do it to me.” (I suggest you do this in private.) Depending on the situation, you might take further disciplinary action based on company history and workplace rules. Whether you take further action or not, focus on specific behaviors and not interpretations.
Here are some examples:
- Rude, inconsiderate, disrespectful, arrogant, obnoxious, flighty, unfocused, smart aleck, and pushy are interpretations.
- Interrupting, rolling eyes, speaking loudly (or softly), shrugging shoulders, looking away, walking away, and tone of voice are specific behaviors.
3. Be Certain
People act based on what they expect to happen to them in the future. Whether it’s avoiding pain or pursuing pleasure, it’s still about expectations. Your employees need to know – without a doubt – what to expect from you based on their actions.
Make sure that everyone clearly understands the rules of conduct in your workplace. Ideally, you will write down anything that is mission critical to your operation. I don’t suggest that you make your employee handbook look like the Code of Federal Regulations, but you should have a few well-written and clearly defined behavioral expectations for your business. People need to know the rules. They need to know what to expect when they follow the rules – and when they don’t.
4. Be Consistent
Consistency works in close partnership with Certainty. It is Certainty’s twin in the daily struggle to create a high-performing, results-oriented team. If you don’t consistently apply your workplace rules, your employees will never develop a sense of certainty.
Consistency applies to both positive and negative behaviors. If you say that you will reward certain behaviors, then always reward them. If you say that certain behaviors are unacceptable, always act to stop them.
5. Be Immediate
Act now. When your employees do something worthy of praise – do it now. When they need correction – do it now. Delayed consequences have very little impact on behavior.
I’ll illustrate the point with my behavior.
I like cheesecake. Eating cheesecake offers me both immediate and future consequences. The future consequence is negative – I could develop a weight or blood pressure problem. The immediate consequence is positive – it tastes good and gives me pleasure. When I have the opportunity to get cheesecake, I find it difficult to resist even though I understand the negative consequences. Why? The immediate, certain positive tends to overshadow the future, possible negative.
Acting immediately has an added benefit when the behavior is inappropriate. If the behavior continues without correction, you are likely to get angrier every time you see it. As you get angrier, you will probably have more difficulty keeping your response proportional to the behavior (i.e. – not blowing your stack). Act now and you will be better able to maintain self-control.

Are You A Spammer?
This is one of those topics which never goes away. No matter how many times the subject comes up, it’s not long after we are spammed. The following are general guidelines to follow.
It’s NOT acceptable to:
- Email your entire address book ads
– Forget using a mailing list
– Forget reading guidelines on groups
– Offer “great ways to make money” to someone that didn’t ask for it
Basically put, s*pam is a message you send to profit yourself which they don’t want. They didn’t ask for it, they don’t need it. It doesn’t matter how great your specials are or how wonderful your business opportunity is. There are millions of great website and opportunities on the internet, and even if you think your’s is the best it may not be to someone else.
What IS acceptable:
- Always use mailing lists
You must use some type of a professional mailing list where others can subscribe or unsubscribe themselves. Double opt-in is a must, which means when they enter their email address it must be confirmed before they are officially subscribed.
- Always include contact information
This is a spam compliance law – you must follow up your mailings with your publishing info INCLUDING mailing address and phone number.
- Always read group guidelines
The fastest way to make a group owner mad is not following their guidelines. You want to make friends, not burn bridges.
Remember: “I didn’t know” is never an excuse, and if someone were to report your email as spam your business could suffer dearly. They say “Ignorance of the law is no excuse”, and the same applies online. To own a business of any kind is a large responsibility, and your job is to know everything there is to know about starting. This includes licences, spam laws, local requirements, etc.

Rambling of a Network Neophyte
I am by and far not the authority or expert in internet network marketing. I only recently dove into this adventure after some consideration. I am going to share with you my troubles and tribulations, and my aspirations and accomplishments. Let me first tell you how I got here.
I currently work as a sports physical therapist at a prestigious academic university hospital in Philadelphia. Although I enjoy what I do (working with athletes), my job is in essence controlled by my employer. So looking for a way to increase my retirement fund, I started researching online about building wealth. I found a great newsletter, called “Early to Rise” by Mike Masterson. It is from here that I got the idea of starting a side business. At first, I tried to work as an independent speaker on issues in sports physical therapy but at the time, the company I contracted with didn’t like the audience turnout that I had. So I put this on the backburner. I plan to resurrect this career with some partners of mine. So I needed something else.
At the same time, I started to read everything I got on building wealth and getting rich. I grow up with the notion that being rich was greedy and not good for the soul. Then I read “Automatic Wealth” by Mike Masterson. He lays out a plan to retire in 7 to 15 years. For me, I have not thought about retiring at such a young age. I have too much that I want to accomplish and then I read “Retire young, retire rich” by Robert Kiyosaki. He said he and his wife retired when they were in their late 30s and 40s. But what he really did was take a year off, write a book, calm his life down, and found his vision for the second half of his life. That was incredible inspiration for me. That I can retire young and rich, take a year off to discover or rediscover and build my vision.
That has brought me here. Robert Allen of “Multiple Streams of Income” said that network marketing is a great place to start regarding build a new stream of income. So I spent several days researching the internet for a good opportunity. And I found it, “PluginProfits.com”. Stone Evans lays out a nice structured format to get into network marketing. Understand me, getting started does take work: time, energy, and money. But I can expect to become rich by not working for it (unless you win the lottery but odds are better with this, and even if you do win, most winners end up poorer than before they won). Thus there is a beginning of my journey. I will keep you up to date on how things are going and what I learn along the way.

How TCA Skin Peels Work
While it is true that physical beauty is just skin deep, it is still no reason why people, particularly women, should disregard basic skin care. Since the skin is our outermost layer, it is exposed to the harsh elements of the environment.
